Meeting of Creditors/341 Hearing
Whether you are filing for a Chapter 7 Bankruptcy in Stuart FL, a Chapter 7 Bankruptcy in Port St. Lucie FL, or a Chapter 7 Bankruptcy in Jupiter, FL, you will be required to attend the meeting of Creditors/341 hearing. The meeting of creditors is where you reaffirm your identity, petition and schedules. The Trustee will ask you questions in lieu of the creditors to make sure you have completely and properly declared all of your assets and income.
Although this meeting may not take very long and there may not be anything wrong with your case, I would be hard pressed to find a client that was not nervous about this part of the process. I think there are so many concerns facing anyone going into the meeting that their fears, irrational as they may be, still come to the surface. This is probably the first time you have ever been involved in a Federal proceeding. There is also the impact of the social stigma attached with Bankruptcy which tangibly rears its head in this part of the process. It is stressful, but you will get through it.
As a preliminary and a prerequisite to the chapter 7 Bankruptcy 341 hearing, it is important you comply with bringing the proper identification with you to the hearing (ideally, social security card and driver’s license). The video below briefly touches on this issue.
