Negative Prepetition Activities

Negative Prepetition Activities

There are some activities which may be routinely carried out by a debtor which could have negative implications on their potential discharge.  It is important to talk to an attorney regarding these potential pitfalls before filing for bankruptcy.  I have had several clients which were the direct result of negative advice given by nonprofessional paralegals: paralegals cannot give legal advice, are not attorneys and cannot represent you in court.

It is important to consult with a lawyer that knows the implications of how you have been conducting your finances, both personal and business to mitigate and address  issues such as improper record keeping, commingling of funds, preferred creditors payments, unexplained loss of assets or improper transfer of assets, etc…

This is one of the most critical and potentially stressful epidsodes in your life.  It is important to know the implications of whether your previous activities will affect your ability to receive a discharge in Bankruptcy.  If you live in Stuart, Port St. Lucie, or Jupiter, FL and are looking for a Bankruptcy Lawyer or have any questions, please give my office a call.

The video below is a brief discussion of the impact of some prepetition activities which could have negative implications on receiving a discharge in Bankruptcy.
