The Statute of limitations is an important concern when considering taking legal action. It can operate as a defense to an action and can bar a claim. Essentially, the Statute of Limitations is the time in which an action can be brought. The Statute is limitations is not uniform for all causes of action. Therefore, it is very important to discuss your with an attorney in order to make sure your cause of action is viable relative to the time the action arose and the time the case is filed.
The Statute of limitations can be tolled (suspended) due to certain conditions and in certain situations. Again it is important to consult with an attorney to determine whether or not this has occurred.
